Attorneys typically charge hourly, much like other professionals, or under a contingency fee agreement. Each of these systems has its own advantages and disadvantages.

Under an hourly fee agreement, the pros are that you will receive dedicated attention to your case. The more time invested in your claim, the more you’re likely to benefit from the legal services. However, the downside is that it can be quite expensive, but you receive top-tier services for this premium. These prices can range anywhere from $150 to an excess of $1,000 or more dollars per hour. For car accident cases, it’s more common to work under a contingency fee agreement.

The benefit of this agreement is that you don’t pay anything upfront for the legal representation. However, in a contingency fee agreement, the attorney will typically take up to 33% of the first million dollars of gross recovery, regardless of how many hours of work are put in before filing a lawsuit. This may or may not be the most cost-effective solution, but it is the most convenient with no risk to you. Keep in mind, after an answer is filed, that percentage may jump up to 40%, and in some cases, an additional 5% can be added if there’s an appeal. This means a lawyer could be taking up to 45% of your gross claim depending on the circumstances of your case.

Due to this payment structure, there are cases that some lawyers may not want to take. For example, cases against the government. In Florida, attorney’s fees are capped at 25% with a maximum recovery limit of $100,000. This means that the most a lawyer can earn from such a case is $25,000, regardless of the effort involved. That’s why many law firms avoid injury cases against the government. Unfortunately, they know that the government fights tooth and nail to make it needlessly difficult for victims to recover.

Some lawyers may also avoid low-impact cases where the financial return doesn’t justify the effort, which may lead to an unfair result for victims. This payment structure can also lead to a less personal approach to handling cases, which we at the Perazzo Law Firm strive to avoid.

Is justice adequately served in this system? I don’t believe any system is perfect. However, a contingency agreement does allow access to a lawyer when one may be out of reach due to financial circumstances.
